SRC-AAA S.B. 238 75(R) BILL ANALYSIS Senate Research CenterS.B. 238 By: Nixon State Affairs 1-21-97 As Filed DIGEST Currently, the law does not set any time limits of lottery contracts, nor does it mandate to competitively bid a new or continuing contract. The current controversies that have engulfed the Lottery Commission have raised questions as to whether the current law governing the contracts of other agencies ought to be applied to the Lottery Commission. This bill would set time limits for state lottery contracts and have a bidding process for contracts to come under the governance of the statutes currently in place. PURPOSE As proposed, S.B. 238 relates to the time limits of state lottery contracts and the bidding process of those contracts. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 466.014, Government Code, by adding Subdivisions (d) and (e) to prohibit a contract under Subsection (b) from having a duration of more than four years. Requires the executive director of the Texas Lottery Commission to use a competitive bidding process that complies with Section 2155.132 and Section 113.11, Title 1, Administrative Code, to award a subcontract under Subsection (b). SECTION 2. Effective date: September 1, 1997. Makes application of this Act prospective. SECTION 3. Emergency clause.
