SRC-JRN S.B. 244 75(R) BILL ANALYSIS Senate Research CenterS.B. 244 By: Harris Finance 2-18-97 As Filed DIGEST Currently, state law exempts veterans of foreign wars, and dependents of veterans who are killed in action or missing in action from certain dues and fees for higher education through the Hazelwood Act. Some veterans have questioned whether or not the Hazelwood Act still applies to certain continuing education courses. This bill clarifies that the Hazelwood Act still applies to certain continuing education courses. PURPOSE As proposed, S.B. 244 clarifies that the Hazelwood Act still applies to certain continuing education courses. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 54.545, Education Code, by amending Subsection (c) and by adding Subsection (d), to provide that Subchapters B and D do not apply to a fee charged to certain military veterans and the children of certain military personnel, except as provided by Subsection (d). Provides that the exemption provided by Sections 54.203(a) and (b), Health and Safety Code, applies to a fee charged under this section. SECTION 2. Emergency clause. Effective date: upon passage.
