DIGEST 

Currently, the Texas Chiropractic College (college) is located in
Pasadena, Texas and has been in operation in Texas since 1908.  This
college has 500 students from 40 states and 10 foreign countries. The
college is interested in becoming  part of  a state university system.
This bill would transfer the college to the Texas A&M University System. 

PURPOSE

As proposed, S.B. 260 transfers the Texas Chiropractic College to the
Texas A&M University System. 

RULEMAKING AUTHORITY

Rulemaking authority is granted to the board of regents of the Texas A&M
University System in SECTION 3(c) of this bill. 

SECTION BY SECTION ANALYSIS

SECTION 1. TRANSFER OF GOVERNANCE.  Provides that the Texas Chiropractic
College is transferred to the board of regents of the Texas A&M University
System (board), if both governing boards agree that the  transfer take
place no later than August 31, 1997, and if agreed, the transfer is
effective September 1, 1997 and is governed by Sections 2 through 8 of
this Act. 

SECTION 2. NAME.  Requires the institution to be known as the Texas A&M
University System-Texas A&M Chiropractic College--Pasadena (college), upon
effect of the transfer. 

SECTION 3. POWERS AND DUTIES; RULES AND POLICIES.  Sets forth the duties
of the Texas A&M University System (system) in undertaking the college.
Authorizes  the college to continue awarding the same degrees as before
the transfer.  Provides that new degree proposals are subject to the
process of other state-supported institutions.  Provides that rules
adopted by the college before the transfer are still in effect until
adopted, repealed or superseded by the board.  Authorizes the board to
adopt rules applicable to the college in anticipation of the transfer. 

SECTION 4.  CONTRACTS AND WRITTEN OBLIGATIONS.  Provides that contracts or
other written obligations of the board of trustees of the Texas
Chiropractic College are ratified, confirmed, and validated. 

SECTION 5.  EFFECT ON EMPLOYEES.  Provides that an employee of the college
will be treated as an employee of the Texas A&M University System, except
service for the Texas Chiropractic College is to be given credit for the
purpose of accruing annual leave time. 

SECTION 6.  TRANSFER OF FUNDING.  Requires  all funds to be transferred to
the board from the Texas Chiropractic College for the use and benefit of
the college. 

SECTION 7. EFFECT ON STUDENTS.  Provides that credit hours earned by
students at the college before the transfer are not affected. 

SECTION 8. LEGISLATIVE INTENT.  Sets forth the intent of the legislature's
transfer of the  Texas Chiropractic College to the Texas A&M University
System. 

SECTION 9. Amends Chapter 87, Education Code, by adding Subchapter J, as
follows: 

SUBCHAPTER J. THE TEXAS A&M UNIVERSITY SYSTEM--TEXAS A&M
 CHIROPRACTIC COLLEGE--PASADENA

Sec. 87.821 THE TEXAS A&M UNIVERSITY SYSTEM--TEXAS A&M CHIROPRACTIC
COLLEGE--PASADENA.  Provides that the college is a component of the system
and under the control of the board.  Sets forth the duties of the board. 

Sec. 87.822  POWERS OF THE BOARD.  Sets forth the duties of the board.
Requires the salary of a person who receives a joint appointment under
this section to be apportioned among the institutions to which the
individual is appointed on the basis of the services rendered.  

SECTION 10. TRANSITION.  Requires the board to publish notice  of the
transfer in the Texas Register, as soon as practicable after the board
certifies that the system has agreed to and completed the transfer. 

SECTION 11. Emergency clause.
  Effective date: upon passage.
