IMF S.B. 360 75(R)BILL ANALYSIS STATE AFFAIRS S.B. 360 By: Armbrister (Stiles) 5-2-97 Committee Report (Amended) BACKGROUND Texas law provides a schedule for the review of state agencies subject to the Texas Sunset Act. Periodically, the Texas Legislature alters the schedule of agencies subject to review by the Sunset Advisory Commission to enhance the efficiency of the review process. PURPOSE S.B. 360 balances the Commission's workload over the next few years, aligns reviews of agencies with similar functions, and makes technical corrections to several Sunset dates to coincide with the years the Legislature meets in regular session. The most significant component of the Senate bill postpones the review of several unrelated agencies to allow the Sunset Commission to concentrate efforts on the state's health and human services agencies during the upcoming biennium. The bill also adds the State Office of Administrative Hearings to the Sunset review schedule for 2003 and sets the Texas Board of Private Investigators and Private Security Agencies for review in the upcoming biennium. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1.01. Amends Section 33.211, Natural Resources Code. Changes the date the Coastal Coordination Council is abolished, unless continued in existence as provided by the Sunset Act, from September 1, 1999, to September 1, 2001. SECTION 2.01. Amends Section 74.127(a), Agriculture Code. Changes the date the board of directors of the official cotton growers' boll weevil eradication foundation is abolished, unless continued in existence as provided by the Act, from September 1, 2004, to September 1, 2003. SECTION 2.02. Amends Section 434.002(a), Government Code. Changes the date the Texas Veterans Commission is abolished, unless continued in existence as provided by the Sunset Act, from September 1, 1999, to September 1, 2003. SECTION 2.03. Amends Section 752.025, Government Code. Changes the date the Governor's Advisory Committee on Immigration and Refugees is abolished, unless continued in existence as provided by the Sunset Act, from September 1, 1999, to September 1, 2003. SECTION 2.04. Adds Section 2003.023, Government Code. Subjects the State Office of Administrative Hearings to Sunset review during the period in which state agencies abolished in 2003 and every 12th year thereafter, are reviewed. The Board is not abolished under the Act. SECTION 2.05. Amends Section 2152.002, Government Code. Changes the date the General Services Commission is abolished, unless continued in existence as provided by the Sunset Act, from September 1, 2001, to September 1, 2003. SECTION 2.06. Amends Section 2306.022, Government Code. Changes the date the Texas Department of Housing and Community Affairs is abolished, unless continued in existence as provided by the Sunset Act, from September 1, 1999, to September 1, 2003. SECTION 2.07. Amends Section 2307.007, Government Code. Changes the date the Texas Interagency Council for the Homeless is abolished, unless continued in existence as provided by the Sunset Act, from September 1, 1999, to September 1, 2003. SECTION 2.08. Amends Section 2308.005, Government Code. Changes the date the Council on Workforce and Economic Competitiveness is abolished, unless continued in existence as provided by the Sunset Act, from September 1, 1999, to September 1, 2003. SECTION 2.09. Amends Section 122.006, Human Resources Code. Changes the date the Texas Council on Purchasing from People with Disabilities is abolished, unless continued in existence as provided by the Sunset Act, from September 1, 1999, to September 1, 2003. SECTION 2.10. Amends Section 301.008, Labor Code. Changes the date the Texas Workforce Commission is abolished, unless continued in existence as provided by the Sunset Act, from September 1, 1999, to September 1, 2003. SECTION 2.11. Amends Section 301.091(b), Labor Code. Changes the date the workforce development legislative oversight committee is abolished, unless continued in existence as provided by the Sunset Act, from September 1, 1999, to September 1, 2003. SECTION 2.12. Amends Section 161.0111, Natural Resources Code. Changes the date the Veteran's Land Board is subject to Sunset review from 1999 to 2003 and every 12th year after 2003. The Board is not abolished under the Sunset Act. SECTION 3.01. Amends Section 88.524(b), Education Code. Changes the date the Equine Research Account Advisory Committee is abolished, unless continued in existence as provided by the Sunset Act, from September 1, 2001, to September 1, 2005. Section 3.02. Section 106.003, Health and Safety Code. Changes the date the Center for Rural Health Initiatives is abolished, unless continued in existence as provided by the Sunset Act, from September 1, 1999, to September 1, 2005. SECTION 3.03. Amends Section 3.606(f), Public Utility Regulatory Act of 1995, Article 1446c0, Vernon's Texas Civil Statutes. Changes the date the Telecommunications Infrastructure Fund Board is abolished, unless continued in existence as provided by the Sunset Act, from September 1, 2006, to September 1, 2005. SECTION 4.01. Amends Section 4(d), Private Investigators and Private Security Agencies Act, Article 4413(29bb), Vernon's Texas Civil Statutes. Changes the date the Texas Board of Private Investigators and Private Security Agencies is abolished, unless continued in existence as provided by the Sunset Act, from September 1, 2003, to September 1, 1999. SECTION 4.02. Instructional provision. Requires the Sunset Commission to review the Texas Board of Private Investigators and Private Security Agencies in coordination with the office of the state auditor. SECTION 5.01. Repeals Section 317.012, Government Code. Repeals the provision requiring the Sunset Commission to review the state budget execution law. SECTION 6.01. Effective date: September 1, 1997. SECTION 6.02. Emergency clause. EXPLANATION OF AMENDMENT Committee amendment no. 1 adds the Texas Housing Corporation with a sunset date of September 1, 2003.
