SRC-TNM S.B. 360 75(R) BILL ANALYSIS Senate Research Center S.B. 360 By: Armbrister State Affairs 4-13-97 As Filed DIGEST Currently, the Texas Legislature alters the schedule of agencies subject to the review by the Sunset Advisory Commission (commission) in order to balance the workload of the commission. S.B. 360 would move the date of certain state agencies which are subject to the Texas Sunset Act in 2004, to September 1, 2003. S.B. 360 would also move a state agency (Telecommunications Infrastructure Fund Board) which is subject to the Texas Sunset Act in 2006, to September 1, 2005. PURPOSE As proposed, S.B. 360 outlines provisions regarding the review and continuation of certain state agencies subject to the Texas Sunset Act. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 74.127(a), Agriculture Code, to provide that the board of directors of the official cotton growers' boll weevil eradication foundation (board) is subject to Chapter 325, Government Code (Texas Sunset Act). Provides that unless continued in existence as provided by that chapter, the board is abolished and this subchapter expires September 1, 2003, rather than 2004. SECTION 2. Amends Chapter 2003B, Government Code, by adding Section 2003.023, as follows: Sec. 2003.023. SUNSET PROVISION. Provides that the State Office of Administrative Hearings (office) is subject to review under Chapter 325 (Texas Sunset Act), but is not abolished under that chapter. Requires the office to be reviewed during the periods in which state agencies abolished in 2003 and every 12th year after 2003 are reviewed. SECTION 3. Amends Section 88.524(b), Education Code, to provide that unless continued in existence as provided by Chapter 325, Government Code, the Equine Research Account Advisory Committee is abolished and this subchapter expires September 1, 2005, rather than 2001. SECTION 4. Amends Section 3.606(f), Article 1446c-0, V.T.C.S. (Public Utility Regulatory Act of 1995), to provide that the Telecommunications Infrastructure Fund Board (TIFB), rather than the board, is subject to Chapters 551 and 2001, Government Code. Provides that unless continued in existence by Chapter 325, Government Code, TIFB, rather than the advisory board, is abolished and this section expires September 1, 2005, rather than 2006. Makes a nonsubstantive change. SECTION 5. Effective date: September 1, 1997. SECTION 6. Emergency clause.
