SRC-TNM C.S.S.B. 360 75(R)BILL ANALYSIS Senate Research CenterC.S.S.B. 360 By: Armbrister State Affairs 4-16-97 Committee Report (Substituted) DIGEST Currently, the Texas Legislature alters the schedule of agencies subject to the review by the Sunset Advisory Commission (commission) in order to balance the workload of the commission. S.B. 360 would move the date of certain state agencies which are subject to the Texas Sunset Act in 2004, to September 1, 2003. C.S.S.B. 360 would also move a state agency (Telecommunications Infrastructure Fund Board) which is subject to the Texas Sunset Act in 2006, to September 1, 2005. PURPOSE As proposed, C.S.S.B. 360 outlines provisions regarding the review and continuation of certain state agencies and laws subject to the Texas Sunset Act. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1.01. Amends Section 33.211, Natural Resources Code, to provide that unless continued in existence by Chapter 325, Government Code, the Coastal Coordination Council is abolished and this subchapter expires September 1, 2001, rather than 1999. SECTION 2.01. Amends Section 74.127(a), Agriculture Code, to provide that the board of directors of the official cotton growers' boll weevil eradication foundation (board) is subject to Chapter 325, Government Code (Texas Sunset Act). Provides that unless continued in existence as provided by that chapter, the board is abolished and this subchapter expires September 1, 2003, rather than 2004. SECTION 2.02. Amends Section 434.002(a), Government Code, to provide that unless continued in existence as provided by Chapter 325, Government Code, the Texas veterans Commission is abolished September 1, 2003, rather than 1999. SECTION 2.03. Amends Section 752.025, Government Code, to make a conforming change. SECTION 2.04. Amends Chapter 2003B, Government Code, by adding Section 2003.023, as follows: Sec. 2003.023. SUNSET PROVISION. Provides that the State Office of Administrative Hearings (office) is subject to review under Chapter 325 (Texas Sunset Act), but is not abolished under that chapter. Requires the office to be reviewed during the periods in which state agencies abolished in 2003 and every 12th year after 2003 are reviewed. SECTION 2.05. Amends Section 2152.002, Government Code, to provide that unless continued in existence by Chapter 325, Government Code, the General Services Commission is abolished and this subtitle expires September 1, 2003, rather than 2001. SECTION 2.06. Amends Section 2306.022, Government Code, to make a conforming change. SECTION 2.07. Amends Section 2307.007, Government Code, to provide that the Texas Interagency Council for the Homeless is subject to Chapter 325 (Texas Sunset Act). Makes a conforming change. SECTION 2.08. Amends Section 2308.005, Government Code, to make a conforming change. SECTION 2.09. Amends Section 122.006, Human Resources Code, to make a conforming change. SECTION 2.10. Amends Section 301.008, Labor Code, to make a conforming change. SECTION 2.11. Amends Section 301.091(b), Labor Code, to provide that the workforce development legislative oversight committee is subject to Chapter 325, Government Code (Texas Sunset Act). Makes a conforming change. SECTION 2.12. Amends Section 161.0111, Natural Resources Code, to make conforming changes. SECTION 3.01. Amends Section 88.524(b), Education Code, to provide that unless continued in existence as provided by Chapter 325, Government Code, the Equine Research Account Advisory Committee is abolished and this subchapter expires September 1, 2005, rather than 2001. SECTION 3.02 Amends Section 106.003, Health and Safety Code, to provide that unless continued in existence by Chapter 325, Government Code, the Center for Rural Health Initiatives is abolished and this chapter expired September 1, 2005, rather than 1999. SECTION 3.03. Amends Section 3.606(f), Article 1446c-0, V.T.C.S. (Public Utility Regulatory Act of 1995), to provide that the Telecommunications Infrastructure Fund Board (TIFB) is subject to Chapters 551 and 2001, Government Code. Provides that unless continued in existence by Chapter 325, Government Code, TIFB, rather than the advisory board, is abolished and this section expires September 1, 2005, rather than 2006. Makes conforming and nonsubstantive change. SECTION 4.01. Repealer: Section 317.012, Government Code (Sunset Review). SECTION 5.01. Effective date: September 1, 1997. SECTION 5.02. Emergency clause.
