BWH S.B. 395 75(R)BILL ANALYSIS COUNTY AFFAIRS S.B. 395 By: Gallegos (Torres) 5-13-97 Committee Report (Amended) BACKGROUND Currently, local governments are not specifically authorized to contract with certain entities. Some entities may not be able to contract for certain services through the competitive bidding process. This bill authorizes a local government to contract with certain entities. PURPOSE This legislation authorizes a local government to contract with certain entities. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 791.025, Government Code, as follows: Sec. 791.025. CONTRACTS FOR PURCHASES. Authorizes a local government, including a council of governments, to agree with certain entities, including the General Services Commission, to purchase goods and services. Provides that certain entities may agree with another local government to purchase goods and any services reasonably required for the installation, operation, or maintenance of the goods. Provides that this subsection does not apply to services provided by firefighters, police officers, or emergency medical personnel. Defines "council of governments." Makes conforming changes. SECTION 2. Emergency clause. Effective date: upon passage. EXPLANATION OF AMENDMENTS Committee Amendment No. 1 amends Section 381.003(c) and (d), Local Government Code whereby a commissioners court may enter into an interlocal contract with a local workforce development board to provide certain services under Chapter 2308, Government Code.
