BLS S.B. 404 75(R)BILL ANALYSIS NATURAL RESOURCES S.B. 404 By: Ratliff (Ramsay) 2-26-97 Committee Report (Unamended) BACKGROUND Currently, the Cypress Valley Navigation District maintains the waterways of Big Cypress Bayou and Caddo Lake located in Marion and Harrison counties. The statute creating the Cypress Valley Navigation District requires a quorum of at least eight members of the board of directors out of a total membership of 10. Because it can be difficult to have eight board members present for each of the meetings, the Cypress Navigation District has requested that the statute be amended to allow a quorum of six board members. S.B. 404 requires the quorum of the board of directors to consist of at least six members. PURPOSE As proposed, S.B. 404 changes the quorum requirements for the board of directors of the Cypress Valley Navigation District from eight members to six members. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 7, Chapter 715, Acts of the 59th Legislature, Regular Session, 1965 (Article 8280-340, V.T.C.S.), to require a quorum at all meetings of the board of directors of the Cypress Valley Navigation District to consist of at least six members rather than eight members. SECTION 2. Emergency clause. Effective date: upon passage.
