SLC S.B. 438 75(R)BILL ANALYSIS LAND & RESOURCE MANAGEMENT S.B. 438 By: Armbrister (Uher) 3-5-97 Committee Report (Unamended) BACKGROUND The view of the Texas State Capitol is expressly protected through site corridors by Article 614513, Vernon's Texas Civil Statutes. SB 438 relates to the planned construction of Darrell K. Royal- Texas Memorial Stadium and provides relief from the application of the 38th and Red River corridor and the Lyndon Baines Johnson Library corridors. PURPOSE SB 438 exempts the Darrell K. Royal - Texas Memorial Stadium from certain provisions of Article 6145-13, Vernon's Texas Civil Statutes. This exemption allows for construction, renovation, and the installation of equipment to take place at the stadium. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 6145-13, Vernon's Texas Civil Statutes, by adding section 7. Section 7 specifically exempts the Darrell K. Royal - Texas Memorial Stadium from the Capitol view corridor guidelines in regards to construction, renovation, or installation of equipment. However, it also states that "the height of the structure or related improvement may not exceed 666 feet above sea level". SECTION 2. Emergency clause. Effective date.
