DIGEST 

Currently, a person who is at least five years of age and under 21 is
entitled to receive certain benefits of the available school fund for that
year.  Because students who are between the ages of 18 and 21 are allowed
to attend school voluntarily, there is no mandatory attendance requirement
for these students to receive the benefits.  This bill provides that a
person who is at least five years of age and under 20 is entitled to the
benefits of the available school fund, but sets forth certain penalties if
a person does not attend school. 

PURPOSE

As proposed, C.S.S.B. 471 provides that a person who is five years of age
and under 20 is entitled to the benefits of the available school fund.
Sets forth certain penalties if a person does not attend school. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 37.001, Education Code, by adding Subsection
(c), to authorize a school district to require a person who voluntarily
enrolls in school after completing the academic year in which the person's
18th birthday occurred to attend school each school day for the entire
period the program of instruction is offered.  Provides that if a person
voluntarily enrolled has unexcused absences from school of 10 or more days
or parts of days in one six-month period or three or more days or parts of
days within a four-week period, a school district is authorized to
withdraw the person from enrollment and prohibit the person from
re-enrolling in the district until the following semester. 

SECTION 2. Provides that this Act applies beginning with the 1997-1998
school year. 

SECTION 3. Emergency clause.
  Effective date: upon passage.
