JLM S.B. 520 75(R) BILL ANALYSIS PUBLIC EDUCATION S.B. 520 By: Bivins (Sadler) 5-18-97 Committee Report (Unamended) BACKGROUND Currently, the governor is required to appoint 12 members to the State Board for Educator Certification. Five members appointed must be citizens who are not and have not been employed by certain entities. PURPOSE As proposed, S.B. 520 requires five of the 12 members appointed to the State Board for Educator Certification to not be currently employed and to not have been employed by certain entities, in the five years preceding the appointment. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 21.033(a), Education Code, to provide that five members of the State Board for Educator Certification appointed by the governor must be citizens who are not and have not been, in the five years preceding appointment, employed by a public school district or by an educator preparation program in an institution of higher education. SECTION 2. Makes application of this Act prospective. SECTION 3. Emergency clause. Effective date: upon passage.
