DIGEST 

Currently, state law requires a city to follow certain procedures in the
sale or exchange of certain lands, including a park property.  The cost of
disposing of park properties raises concern among some communities, as in
the case of Garland. This bill allows municipalities to sell or dispose of
park property without a public election process. 

PURPOSE

As proposed, S.B. 544 allows municipalities to sell and/or dispose of park
property without a public election process. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 253.001(b), Local Government Code, to prohibit
land owned, held, or claimed as a public square, rather than a park, from
being sold unless certain requirements are met.  Makes conforming and
nonsubstantive changes. 

SECTION 2. Repealer: Sections 253.001(e), (f), and (g), Local Government
Code, (Sale of Park Land, Municipal Building Site, or Abandoned Roadway). 

SECTION 3. Makes application of this Act prospective.

SECTION 4. Emergency clause.
  Effective date: upon passage.
