SRC-CDH S.B. 580 75(R) BILL ANALYSIS Senate Research Center S.B. 580 By: Duncan Criminal Justice 5-21-97 As Filed DIGEST Currently, the office of the county attorney for Crosby County is funded outside of the Professional Prosecutors Act. However, the county attorney of Crosby County has the same felony responsibility as a district attorney, who is entitled to funding outside of this Act. S.B. 580 includes the county attorneys performing the duties of district attorneys in Crosby County among those prosecutors entitled to funding outside of the Act and deletes the provision regarding the commissioners court's compensation of county attorneys in Crosby County. PURPOSE As proposed, S.B. 580 establishes the application of the professional prosecutors law to the county attorney of Crosby County. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 46.002, Government Code, to include the county attorneys performing the duties of district attorneys in Crosby County among those prosecutors to whom this chapter applies. SECTION 2. Amends Section 45.154, Government Code, to delete existing Subsection (b), authorizing the commissioners court to pay the county attorney the compensation it considers advisable, and requiring the court to pay the county attorney certain sufficient compensation. Makes a conforming change. SECTION 3. Effective date: September 1, 1997. SECTION 4. Emergency clause.
