SRC-SLL S.B. 630 75(R) BILL ANALYSIS Senate Research Center S.B. 630 By: Duncan Finance 2-20-97 As Filed DIGEST Currently, Texas counties are not entitled to compensation from the state for the costs of confining certain state inmates. This bill will require the state to reimburse counties for the costs of confining certain state inmates. PURPOSE As proposed, S.B. 630 requires the state to reimburse counties for the costs of confining certain state inmates. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 104.002, Code of Criminal Procedure, to provide that a county that confines in the county jail certain inmates is entitled to receive compensation from the state for each day the inmate is confined in the county jail, other than the first 10 days after the date on which the county informs the Texas Department of Criminal Justice that the inmate is confined in the jail. Requires the county judge to certify to the comptroller of public accounts, on the first day of each quarter of a county's fiscal year, each inmate and, for each inmate, the number of days during the preceding fiscal quarter for which the county is entitled to compensation under this subsection. Requires the comptroller to issue to the commissioners court of the county a warrant in an amount computed for the preceding fiscal quarter by using a certain formula. Defines "average daily inmate cost." SECTION 2. Makes application of this Act prospective. SECTION 3. Emergency clause. Effective date: upon passage.
