CN S.B. 670 75(R)BILL ANALYSIS JUVENILE JUSTICE & FAMILY ISSUES S.B. 670 By: Shapiro (Staples) 5-1-97 Committee Report (Unamended) BACKGROUND Currently, children who are eligible for adoption are spending over 40 months in foster care before they are placed in an adoptive home. The Department of Protective and Regulatory Services (DPRS) has limited staff to recruit, study, and place children with potential adoptive families. This bill provides for a monetary incentive to be given to any licensed child-placing agency that successfully assists in the adoption of a child in the care of DPRS. PURPOSE As proposed, S.B. 670 provides for a monetary incentive to be given to any licensed child-placing agency that successfully assists in the adoption of a child in the care of the Department of Protective and Regulatory Services. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 162, Family Code, by adding Subchapter G, as follows: SUBCHAPTER G. MISCELLANEOUS PROVISIONS Sec. 162.601. INCENTIVES FOR LICENSED CHILD-PLACING AGENCIES. Requires the Department of Protective and Regulatory Services to pay a monetary incentive to a licensed child-placing agency for the completion of certain adoptions. Sets forth the calculation of the incentive. Provides that an adoption is completed on the date on which the court issues an adoption order. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 1997. SECTION 4. Emergency clause.
