DIGEST

Currently, a home-rule municipality with more than 225,000 inhabitants is
authorized to annex an area only if authorized to do so under its
home-rule charter. This legislation makes limited purpose annexations
possible for all home-rule municipalities regardless of the home-rule
charter's provisions in an effort to preempt the argument that a
municipality is precluded from annexing for limited purposes due to the
lack of such authority by its charter.

PURPOSE

As proposed, S.B. 704 establishes limited-purpose annexation by certain
home-rule municipalities.

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 43.121(a), Local Government Code, to authorize
the governing body of a home-rule municipality with more than 225,000

Deletes the provision authorizing annexation by a home-rule municipality
only if authorized under its home rule charter to do so.

SECTION 2. Emergency clause.
  Effective date: upon passage.
