DIGEST 

Currently, the Private Investigators and Private Security Agencies Act
does not exempt reserve peace officers from the Act.  Housing authorities
often have serious security concerns.  But with shrinking federal dollars,
it is difficult to fund off-duty police officers at $20-$25 an hour for
basic services. Hiring their  own security officers could help these
authorities reduce costs while keeping the housing safer.  This bill will
exempt certain reserve peace officers from the application of the Private
Investigators and Private Security Agencies Act. 

PURPOSE

As proposed, S.B. 733 exempts certain reserve peace officers from the
application of the Private Investigators and Private Security Agencies
Act. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 3(a), Article 4413(29bb), V.T.C.S. (Private
Investigators and Private Security Agencies Act), to provide that this Act
does not apply to a reserve peace officer who receives compensation for
private employment as a patrolman, guard, or watchman if the reserve peace
officer  meets certain criteria. 

SECTION 2. Effective date: September 1, 1997.

SECTION 3. Emergency clause.
