SRC-SLL S.B. 751 75(R) BILL ANALYSIS Senate Research Center S.B. 751 By: Moncrief Health & Human Services 3-13-97 As Filed DIGEST The psychiatric hospital reforms passed into law during the 73rd Legislature included a provision aimed at providers which were transporting fraudulently referred clients to their facilities. The legislation was not intended to include non-psychiatric hospitals which provide free transportation as a community service, such as bringing in low-income elderly individuals for free blood pressure screening. This bill will provide that Section 161.091 of the Health and Safety Code is not to be construed to prohibit providing transportation to certain individuals under certain conditions. PURPOSE As proposed, S.B. 751 provides that Section 161.091, Health and Safety Code, is not to be construed to prohibit providing transportation to certain individuals under certain conditions. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 161.091, Health and Safety Code, by adding Subsections (g) and (h), to prohibit this section from being construed to prohibit providing transportation for health care services to adult patients as a community service if certain conditions are met. Defines "health care services." SECTION 2. Effective date: September 1, 1997. SECTION 3. Emergency clause.
