DIGEST 

Currently, no state law exists to prohibit a board of trustees or
superintendent of a school district from adopting a policy that
establishes an exclusive arrangement of consulting with a school district
employee organization.  By adopting a policy that establishes an exclusive
arrangement, a school district may restrict the input regarding
educational and personnel matters to only one source.  This bill prohibits
a board of trustees or superintendent of a school district from adopting a
policy that establishes an exclusive arrangement of consulting with a
school district employee organization. 

PURPOSE

As proposed, S.B. 776 prohibits a board of trustees or superintendent of a
school district from adopting a policy that establishes an exclusive
arrangement of consulting with a school district employee organization. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Chapter 22A, Education Code, by adding Section 22.006,
as follows: 

Sec. 22.006. EXCLUSIVE ARRANGEMENT WITH EMPLOYEE ORGANIZATION. Prohibits a
board of trustees or superintendent of a school district from adopting a
policy that establishes an exclusive arrangement of consulting with a
school district employee organization. 

SECTION 2. Emergency clause.
  Effective date: upon passage.
