DIGEST 

Current law does not prohibit a solid waste disposal landfill from being
located in a residential area, or in the vicinity of a school or airport.
This bill will prohibit the issuance of a permit for a municipal solid
waste landfill within one mile of a residential area, a school, or an
airport. 

PURPOSE

As proposed, S.B. 830 prohibits the issuance of a permit for a municipal
solid waste landfill within one mile of a residential area, a school, or
an airport. 

RULEMAKING AUTHORITY

Rulemaking authority is granted to the Texas Natural Resource Conservation
Commission in SECTION 1 (Section 361.116, Health and Safety Code) of this
bill. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Chapter 361C, Health and Safety Code, by adding Section
361.116, as follows: 

Sec.  361.116.  PROHIBITION ON PERMIT FOR MUNICIPAL SOLID WASTE LANDFILL
WITHIN CERTAIN DISTANCE OF RESIDENTIAL AREA, SCHOOL, OR AIRPORT.  Requires
the Texas Natural Resource Conservation Commission (TNRCC), by rule, to
prohibit the issuance of a permit for a new municipal solid waste landfill
that is located within one mile of a residential area, a school, or an
airport.  Requires TNRCC, by rule, to define "residential area" for
purposes of this section. 

SECTION 2. Effective date: September 1, 1997.
  Makes application of this Act prospective.

SECTION 3. Emergency clause.
