SRC-HRD S.B. 924 75(R) BILL ANALYSIS Senate Research Center S.B. 924 By: Nixon State Affairs 3-11-97 As Filed DIGEST Currently, Texas law prohibits a manufacturer or distributor of new motor vehicles, or a representative of a manufacturer or distributor of new motor vehicles from operating as a dealer except on a temporary basis. This bill would provide an exception to this provision to allow such a manufacturer, distributor, or representative to operate as a motor home dealer. PURPOSE As proposed, S.B. 924 authorizes a manufacturer or distributor of new motor vehicles, or a representative of a distributor or manufacturer of new motor vehicles, to operate as a motor home dealer. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends 5.02(b), Article 4413(36), V.T.C.S. (Texas Motor Vehicle Commission Code), to provide that it is unlawful for any manufacturer or distributor of new motor vehicles, or a representative of a distributor or manufacturer of new motor vehicles, to operate as a dealer, other than a motor home dealer, except on a temporary basis and only under certain circumstances. SECTION 2. Emergency clause. Effective date: upon passage.
