SRC-HRD C.S.S.B. 924 75(R)BILL ANALYSIS Senate Research CenterC.S.S.B. 924 By: Nixon State Affairs 4-21-97 Committee Report (Substituted) DIGEST Currently, Texas law prohibits a manufacturer or distributor of new motor vehicles, or a representative of a manufacturer or distributor of new motor vehicles from operating as a dealer except on a temporary basis. This bill would provide an exception to this provision to allow a manufacturer, distributor, or representative, that meets certain qualifications, to operate as a motor home dealer. PURPOSE As proposed, C.S.S.B. 924 authorizes a manufacturer or distributor of new motor vehicles, or a representative of a distributor or manufacturer of new motor vehicles, to operate as a motor home dealer. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Authorizes, notwithstanding the provisions of Section 5.02(b)(25), Article 4413(36), V.T.C.S. (Texas Motor Vehicle Commission Code), a person who, on June 7, 1995, held both a motor home dealer's license and a motor home manufacturer's license issued under the provisions of Article 4413(36), V.T.C.S., to hold both a license as a motor home dealer and a license as a motor home manufacturer under Article 4413(36), V.T.C.S. Provides that Subsection (a) of this section does not authorize a person to operate as a manufacturer and a dealer of any vehicle or type of vehicle except a motor home, as that term is defined by Article 4413(36), V.T.C.S.
