SRC-AAA S.B. 1013 75(R) BILL ANALYSIS Senate Research Center S.B. 1013 By: Ogden Finance 3-18-97 As Filed DIGEST Currently, crime statistics are growing with the growth in population in Leon and Madison counties. Both these counties are sharing a district attorney. This system using a multi-county prosecutor is unworkable, as there is a backlog of cases. This bill creates a separate district attorney for both Leon and Madison counties. PURPOSE As proposed, S.B. 1013 creates a separate district attorney for both Leon and Madison counties. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 44.001, Government Code, to add Leon and Madison counties to the list of counties in which voters elect a criminal district attorney. SECTION 2. Amends Chapter 44B, Government Code, by adding Sections 44.245 and 44.257, as follows: Sec. 44.245. LEON COUNTY. Sets forth powers and duties for a criminal district attorney of Leon County. Sec. 44.257. MADISON COUNTY. Sets forth powers and duties for a criminal district attorney of Madison County. SECTION 3. Amends Section 46.002, Government Code, to abolish the office of district attorney for the 12th Judicial District. Provides that this chapter applies to criminal district attorneys in Leon and Madison counties. SECTION 4. Abolishes the office of county attorney for Leon and Madison counties. SECTION 5. Repealer: Section 43.106, Government Code (12th Judicial District). SECTION 6. (a) and (b) Sets forth requirements for election and term for criminal district attorney in Leon and Madison counties. (c) Effective date for this section: September 1, 1997. SECTION 7. Provides that this Act takes effect January 1, 1999, except as otherwise provided. SECTION 8. Emergency clause.
