DIGEST 

Currently, Section 204.010(a)(9), Property Code, is ambiguous and was used
to raise fees without the vote of homeowners.  S.B. 1030 provides that the
authority granted under Subsection (a)(9) does not permit a property
owners' association to provide an additional service and impose payments,
fees, or charges for the additional service without obtaining the approval
of the property owners as provided by this chapter. 

PURPOSE

As proposed, S.B. 1030 provides that the authority granted under Section
204.010(a)(9), Property Code,  does not permit a property owners'
association to provide an additional service and impose payments, fees, or
charges for the additional service without obtaining the approval of the
property owners as provided by this chapter. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 204.010, Property Code, by adding Subsection
(c), to provide that the authority granted under Subsection (a)(9) does
not permit a property owners' association to provide an additional service
and impose payments, fees, or charges for the additional service without
obtaining the approval of the property owners as provided by this chapter. 

SECTION 2. Emergency clause.
  Effective date: upon passage.
