SRC-CDH S.B. 1065 75(R) BILL ANALYSIS Senate Research Center S.B. 1065 By: Carona State Affairs 3-13-97 As Filed DIGEST Currently, the Texas Department of Licensing and Regulation implements the boiler inspection program, which requires power boilers and other unfired steam boilers to be inspected internally and externally by certified inspectors every 12 months. However, the commissioner of licensing and regulation and an authorized inspection agency may jointly approve extensions of the inspection interval to a period of 24 months for power boilers and 60 months for other unfired steam boilers. This legislation increases the length of the allowable inspection interval extension to 48 months for power boilers and 84 months for unfired steam boilers. PURPOSE As proposed, S.B. 1065 establishes the interval between internal inspection of boilers. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS ARTICLE 1 SECTION 1. Amends Section 755.026(a), Health and Safety Code, to authorize the interval between internal inspections of a power boiler to be extended to a period not exceeding a total of 48, rather than 24, months with the approval of the commissioner of licensing and regulation and the inspection agency that has jurisdiction for the power boiler. Authorizes the inspection interval to be extended to the next scheduled downtime of the boiler, but not exceeding a total of 84, rather than 60, months for other unfired steam boilers or steam collection or liberation drums of process steam generators. Makes conforming changes. ARTICLE 2 SECTION 2.01. Affective date: September 1, 1997. SECTION 2.02. Emergency clause.
