DIGEST 

Currently, the justice of the peace has access to names drawn from the
jury wheel for justice court juries.  The problem is that constables were
inadvertently omitted from names drawn from the jury wheel. S.B. 1083
requires a district clerk and the sheriff or any constable of a county to
draw names of prospective juror.  

PURPOSE

As proposed, S.B. 1083 requires a district clerk and the sheriff or any
constable of the county to draw names of prospective jurors.  

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Sections 62.004(a)-(d), Government Code, to require a
district clerk and the sheriff or any constable of the county to draw
names of prospective jurors. Makes conforming changes.  

SECTION 2. Amends Section 62.015(b), Government Code, to make conforming
changes. 

SECTION 3. Emergency clause.
  Effective date: upon passage.
