DIGEST 

Currently, state law allows elections to be held on private property in
instances when public locations are not available for the holding of
elections.  Because private property owners may determine who is allowed
on their property, some private voting locations may not allow
electioneering activities on their premises.  This bill prohibits the
holding of elections at locations where electioneering is not permitted. 

PURPOSE

As proposed, S.B. 1088 prohibits the holding of elections at locations
where electioneering is not permitted. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 43.031(d), Election Code, to prohibit a polling
place from being located in a building under this subsection unless
electioneering is permitted on the building's premises outside the
prescribed limits within which electioneering is prohibited. 

SECTION 2. Effective date: September 1, 1997.

SECTION 3. Emergency clause.
