SRC-JFA S.B. 1091 75(R) BILL ANALYSIS Senate Research Center S.B. 1091 By: Patterson State Affairs 3-18-97 As Filed DIGEST Currently, a qualified voter has the options of requesting an early voting by mail application if the voter is disabled, has a physical condition or sickness which prevents the voter from appearing in person, will be in childbirth, is serving time in jail (not convicted), or is over the age of 65. Many campaigns target voters over the age of 65 for early voting. This bill would repeal Section 82.003, Election Code, providing that a qualified voter is eligible for early voting by mail if the voter is 65 years of age or older on election day. PURPOSE As proposed, S.B. 1091 repeals Section 82.003, Election Code, providing that a qualified voter is eligible for early voting by mail if the voter is 65 years of age or older on election day. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Repealer: Section 82.003, Election Code (Age). SECTION 2. Effective date: September 1, 1997. SECTION 3. Emergency clause.
