DIGEST 

Currently, no Texas law authorizes lottery winning prizes to be applied to
the payment of child support.  Wage garnishment liens are not accepted by
the Lottery Commission from private attorneys.  This bill authorizes
lottery winning prizes to be applied to the payment of child support. 

PURPOSE

As proposed, S.B. 1096 authorizes lottery winning prizes to be applied to
the payment of child support. 

RULEMAKING AUTHORITY

Rulemaking authority is granted to the Texas Lottery Commission in SECTION
1 (Chapter 466I, Government Code) of this bill. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Chapter 466I, Government Code, by adding Section
466.4075, as follows: 

Sec. 466.4075.  DEDUCTIONS OF CHILD SUPPORT FROM CERTAIN LOTTERY WINNINGS.
Requires this section to apply only to a prize that is required to be
awarded by the director of the lottery division (director) under Section
466.402(b).  Requires the executive director of the Texas Lottery
Commission (executive director) to deduct an amount a court has ordered a
person to pay as child support from a person's winnings, if the director
has been provided with certain information.  Requires the executive
director to pay the balance to the person if a person's winnings exceed
the amount deducted under Subsection (b) and Section 466.407.  Requires
the executive director to transfer the money deducted under Subsection (b)
to the clerk of the court that issued the order for placement in the
registry of the court.  Sets forth types of rules that the Texas Lottery
Commission is required to adopt.   

SECTION 2. Emergency clause.
  Effective date: upon passage.
