SRC-AAA S.B. 1109 75(R) BILL ANALYSIS Senate Research Center S.B. 1109 By: Duncan Jurisprudence 3-21-97 As Filed DIGEST Currently, the law is ambiguous with regards to the award of attorney's fees against municipalities. This bill provides that attorney's fees should not be awarded against a municipality. PURPOSE As proposed, S.B. 1109 provides that attorney's fees should not be awarded against a municipality. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 101.060(a), Civil Practice and Remedies Code, to provide that this chapter does not apply to a claim arising from the removal or destruction of road warning signs by a third person, unless a government unit fails to correct the removal or destruction within a reasonable time after receiving actual written notice. SECTION 2. Effective date: September 1, 1997. Makes application of this Act prospective. SECTION 3. Emergency clause.
