DIGEST 

Currently, the Department of Public Safety (DPS) has increased the amount
of information it releases on a driver's motor vehicle report. This
information includes weight tickets and minor equipment violations for
truck drivers and their commercial vehicles. There are concerns that the
release of this additional information has increased the cost of driver's
personal automobile insurance coverage. This bill provides that only
convictions for motor vehicle moving violations, as determined by DPS,
will be reported on a driver's record.   

PURPOSE

As proposed, S.B. 1268 provides that only convictions for motor vehicle
moving violations, as determined by the Department of Public Safety, will
be reported on a driver's record.    

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 521.046(a), Transportation Code, to authorize
the Department of Public Safety (DPS) to disclose information regarding
each reported motor vehicle moving violation as defined by DPS rule,
resulting in a traffic law conviction and each motor vehicle accident in
which the individual received a citation, by date and location, within
three years preceding the date of the request to certain persons. 

SECTION 2. Effective date:  September 1, 1997.

SECTION 3. Emergency clause.
