JWW S.B. 1273 75(R)BILL ANALYSIS PUBLIC SAFETY S.B. 1273 By: Armbrister (Carter) 5-8-97 Committee Report (Unamended) BACKGROUND Currently, the Private Investigators and Private Securities Act permits persons holding a sellers' certificate to sell detection or other devices for preventing or detecting burglary to serve a person's residence. This bill permits persons with a seller's certificate to sell detection or other devices for preventing or detecting burglary for commercial use as well as residential use. PURPOSE This bill allows a person with a seller's certificate to sell detection or other devices for preventing or detecting burglary for commercial use as well as residential use. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 3A(a), Article 4413(29bb), V.T.C.S. (Private Investigators and Private Security Agencies Act), to provide that the provisions of this Act do not apply to a person who sells detection devices or other devices for preventing or detecting burglary, rather than burglary in a person's residence, if certain conditions exist. SECTION 2. Effective Date: September 1, 1997. SECTION 3. Emergency Clause.
