SCT S.B. 1310 75(R) BILL ANALYSIS STATE FEDERAL & INTERNATIONAL RELATIONS S.B. 1310 By: Ellis (Janek) 5-9-97 Committee Report (Amended) BACKGROUND Currently, Texas law allows cities to use certificates of obligation to demolish dangerous structures as a tool to combat neighborhood deterioration. S.B. 1310 would allow cities to use certificates of obligation to restore and resell historic structures that have fallen into disrepair. PURPOSE As proposed, S.B. 1310 outlines provisions regarding historic structures, including the restoration and preservation of historic structures by a municipality. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends section 271.0461, Local Government Code, as follows: Sec. 271.0461. New heading: ADDITIONAL PURPOSE FOR CERTIFICATES: DEMOLITION OF DANGEROUS STRUCTURES OR RESTORATION OF HISTORIC STRUCTURES. Authorizes certificate of obligation to be issued by any municipality for the payment of contractual obligations to be incurred in demolishing dangerous structures or restoring historic structures. SECTION 2. Amends Section 442.001, Government Code to redefine "historic structure." Makes a conforming change. SECTION 3. Emergency clause. Effective date: upon passage. EXPLANATION OF AMENDMENTS In SECTION 2, Section 442.001 part(6) the amendment strikes the part "with a population of more than 1.5 million", thus releasing that population restiction from the bill. It also adds the wording in place of the stricken language"Nothing in this Chapter shall be construed as prohibting or limiting operations at an airport or overflights by an aircraft; nor shall such operations or overflights be construed as adversely affecting historic structures or property."
