SRC-MAX S.B. 1389 75(R) BILL ANALYSIS Senate Research Center S.B. 1389 By: Lindsay State Affairs 4-21-97 As Filed DIGEST When the 74th legislature passed S.B. 14 (the "Takings Act"), it chose to exempt counties for two years. This exemption allowed for a period of observation relating to the implementation of this new law and any litigation that may be initiated due to the provisions of the law. S.B. 1389 extends the exemption period for certain political subdivisions granted in the Takings Act. PURPOSE As proposed, S.B. 1389 extends the exemption period for certain political subdivisions granted by the Takings Act. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 2007.003(d), Government Code, to provide Chapter 2007.003, Government Code, applies to a governmental action taken by a county or by a political subdivision for which the commissioners court is the governing body only if the action is taken on or after September 1, 1999, rather than 1997. SECTION 2. Effective date: September 1, 1997. SECTION 3. Emergency clause.
