SRC-SLL S.B. 1441 75(R) BILL ANALYSIS Senate Research Center S.B. 1441 By: Wentworth Natural Resources 3-26-97 As Filed DIGEST Currently, the Bexar Metropolitan Water District is required to get approval before issuing bonds from the Office of the Attorney General and the Texas Natural Resource Conservation Commission. When the district was created in 1948, the district was required to get approval from the attorney general's office before issuing bonds. When Texas water laws were codified, pre-approval of bonds were applied to most water districts, including the Bexar Metropolitan Water District. This bill will exempt the district from Sections 49.181 and 49.183, Water Code, to the extent that the sections apply to the issuance or sale of bonds. PURPOSE As proposed, S.B. 1441 exempts the Bexar Metropolitan Water District from Sections 49.181 and 49.183, Water Code, to the extent that the sections apply to the issuance or sale of bonds. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 8280-126, V.T.C.S. (Chapter 306, Acts of the 49th Legislature, Regular Session, 1945), by adding Section 15A, as follows: Sec. 15A. Provides that Sections 49.181 and 49.183, Water Code, do not apply to the issuance or sale of district bonds. SECTION 2. (a) Provides that the requirements regarding proper and legal notice of the intention to introduce this Act have been met. (b) Provides that the Texas Natural Resource Conservation Commission has filed its recommendations relating to this Act with certain persons within the required time. (c) Provides that all requirements of the constitution and laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished. SECTION 3. Emergency clause. Effective date: upon passage.
