DIGEST 

Currently, Section 201.051, Title 6, Transportation Code, 
requires one member of the three-member 
Transportation Commission (commission) to reside in a rural area. 
 This code also requires each 
member of the commission to represent the general public.  There 
are concerns that these two 
provisions seem to conflict.  This bill repeals Section 
201.051(b), Transportation Code, relating to 
the residence of certain members of the commission.

PURPOSE

As proposed, C.S.S.B. 1442 sets forth provisions for the 
appointment of the members of the Texas 
Transportation Commission.

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a 
state officer, institution, or agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Repealer:  Section 201.051(b), Transportation Code 
(Commission).

SECTION 2. Effective date:  September 1, 1997.

SECTION 3. Emergency clause.
