SRC-JRN S.B. 1522 75(R) BILL ANALYSIS Senate Research Center S.B. 1522 By: Lucio Education 5-1-97 As Filed DIGEST In 1993, South Texas Community College was created under special legislation, codified as Section 130.0311, Education Code. Because South Texas Community College was converted from a branch campus of Texas State Technical College, the transition from a state entity to a local entity was accomplished without significant statutory coverage. This bill establishes the validation process necessary to assist the South Texas Community College transition from a state entity to a local entity. PURPOSE As proposed, S.B. 1522 establishes the validation process necessary to assist the South Texas Community College transition from a state entity to a local entity. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 130C, Education Code, by adding Section 130.0312, as follows: Section 130.0312. VALIDATION OF SOUTH TEXAS COMMUNITY COLLEGE ACTS AND PROCEEDINGS. APPLICATION Sec. 1. Provides that all governmental acts and proceedings of South Texas Community College (college), since its creation, are validated as the dates on which they occurred. CONFIRMATION PROCEEDINGS Sec. 2. Provides that the confirmation proceedings of the college are validated as of the date of the confirmation or attempted confirmation and the confirmation of the college shall not be held invalid by the fact that the election proceedings or confirmation proceedings may have not been in accordance with the law. Provides that all governmental proceedings performed by the board of the college and their officers since the confirmation or attempted confirmation proceedings of the college are validated as the date of such proceedings. EFFECTIVE LITIGATION Sec. 3. Provides that this Act does not apply to certain matters occurring on the effective date. Sets forth matters that do not apply to this bill. SECTION 2. Emergency clause. Effective date: upon passage.
