SLC C.S.S.B. 1621 75(R)BILL ANALYSIS LAND & RESOURCE MANAGEMENT C.S.S.B. 1621 By: Duncan (Isett) 5-5-97 Committee Report (Substituted) BACKGROUND Currently, Texas Tech University is planning to construct a sports facility that may also be used for graduations, concerts, and special events. Because of this proposed facility, the City of Lubbock desires the option to convert for other purposes or dispose of all or a portion of the auditoriumcoliseum located in Lubbock. This bill allows the City of Lubbock and Texas Texas Tech University the option of continuing operation of the auditorium portion of the auditorium-coliseum and of maintaining ownership of the parking lot in order to be in a position to schedule events at the auditorium. PURPOSE CSSB 1621 allows the City of Lubbock and Texas Texas Tech University the option of continuing operation of the auditorium portion of the auditorium-coliseum and of maintaining ownership of the parking lot in order to be in a position to schedule events at the auditorium. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 185, Acts of the 48th Legislature, 1943, by adding Section 4 as follows: Sec. 4. (a) Allows the City of Lubbock to demolish any part of the auditorium-coliseum complex that has been conveyed or leased, if the city receives voter approval. (b) Allows the City of Lubbock to continue to use the area formerly occupied by the auditorium-coliseum, under certain conditions. SECTION 2. Emergency clause. Effective date. COMPARISON OF ORIGINAL TO SUBSTITUTE CSSB 1621 deletes the language contained in SECTION 1, section 3A, of the original Act and replaces it by inserting Sec. 4. (a) and (b). Sec. 4(a) allows the City of Lubbock to demolish any part of the auditorium-coliseum complex that has been conveyed or leased, if the city receives voter approval. Sec. 4(b) allows the City of Lubbock to continue to use the area formerly occupied by the auditorium-coliseum, under certain conditions. The original Act did not contain these provisions. CSSB 1621 deletes SECTION 2 and SECTION 3 of the original Act. The emergency clause is inserted in SECTION 2 of CSSB 1621.
