DIGEST 

Currently, Texas Tech University is planning to construct a sports
facility that may also be used for graduations, concerts, and special
events.  Because of this proposed facility, the City of Lubbock desires
the option to convert for other purposes or dispose of all or a portion of
the auditoriumcoliseum located in Lubbock.  This bill allows the City of
Lubbock and Texas Texas Tech University the option of continuing operation
of the auditorium portion of the auditorium-coliseum and of maintaining
ownership of the parking lot in order to be in a position to schedule
events at the auditorium. 

PURPOSE

As proposed, S.B. 1621 allows the City of Lubbock and Texas Texas Tech
University the option of continuing operation of the auditorium portion of
the auditorium-coliseum and of maintaining ownership of the parking lot in
order to be in a position to schedule events at the auditorium. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Chapter 185, Acts of the 48th Legislature, Regular
Session, 1943, as amended by Chapter 98, Acts of the 53rd Legislature,
Regular Session, 1953, by adding a new SECTION 4, as follows: 

SECTION 4. Authorizes the City of Lubbock and Texas Tech University to
enter into agreements and execute conveyances that are mutually
satisfactory to the Board of Regents of Texas Tech and to the City Council
of Lubbock.  Provides that conveyances regard the continued use, lease, or
demolition of all or part of the auditorium-coliseum complex that has been
constructed and the use or lease of the land that has been conveyed,
leased, or upon which easements have been granted, pursuant to Section 1
of this Act.  Requires the City of Lubbock to obtain approval of the
voters at an election prior to the demolition of all or part of the
auditorium-coliseum. 

SECTION 2. Prohibits any part of this Act that is held to be invalid from
affecting the remainder of the Act. 

SECTION 3. Provides that all or parts of laws in conflict with this Act
are hereby expressly repealed to the extent of the conflict. 

SECTION 4. Emergency clause.
  Effective date: upon passage.
