SRC-JFA S.B. 1664 75(R) BILL ANALYSIS Senate Research Center S.B. 1664 By: Shapiro Criminal Justice 4-20-97 As Filed DIGEST Currently, the offense of contributing to the delinquency of a minor was inadvertently deleted by the passage of legislation, during the 75th Legislature, 1995, in revising the Family Code. This bill would recodify the offense of contributing to the delinquency or dependency of a child. PURPOSE As proposed, S.B. 1664 provides that a person commits a Class A misdemeanor for contributing to the delinquency or dependency of a child. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Title 3, Family Code, by adding Chapter 61, as follows: CHAPTER 61. CONTRIBUTING TO DELINQUENCY OR DEPENDENCY OF A CHILD Sec. 61.001. DEFINITIONS. Defines "child" and "delinquency." Sec. 61.002. OFFENSE. Provides that a person commits a Class A misdemeanor if, in any case in which a child is caused to become a delinquent or a dependent and neglected child, the person encourages by any act, causes in conjunction with, or contributes to the delinquency, dependency, or neglect of a child. Sec. 61.003. EXCLUDED DEFENSE. Provides that it is not a defense to prosecution under Section 61.002 that the child has not been declared a delinquent child or a dependent or neglected child. SECTION 2. Effective date: September 1, 1997. SECTION 3. Emergency clause.
