NDT S.B. 1787 75(R) BILL ANALYSIS LICENSING & ADMINISTRATIVE PROCEDURES S.B. 1787 By: Cain (Patterson) 5-22-97 Committee Report (Unamended) BACKGROUND Currently, within Fannin County there is a vineyard/winery where grapes are grown and harvested and wine is manufactured and bottled on the premises. Considerable interest has developed in touring and holding special events at the winery. Local officials would like to hold a special "Harvest Festival" during harvest time at the winery to allow tourists to watch grapes being harvested and see the winery in operation. S.B. 1787 would authorize the sale of wine for off-premises consumption by the holder of a winery permit located in certain dry areas and under certain conditions. PURPOSE S.B. 1787 outlines provisions regarding the restricted sale of wine for off-premises consumption by the holder of a winery permit in certain areas. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 16.05, Alcoholic Beverage Code, to authorize the permittee to sell wine in this state, if the premises are in a dry area, to a county that has a population of at least 20,000 but not more than 30,000 and that borders the Red River in which a majority of the area of the county is a dry area. SECTION 2. Emergency clause. Effective date: 90 days after adjournment.
