DIGEST 

Currently, site-based decision-making is a substantial component of
efforts to improve public schools.  Section 11.251, Education Code,
requires school districts to adopt policies and administrative procedure
governing site-based decision-making.  Although these policies and
procedures are intended to establish the respective responsibilities of
school administrators and district- and campus-level committees, there is
no statutory requirement that superintendents, principals, and committee
members fulfill their responsibilities.  S.B. 1822 would require
superintendents and principals to consult with and consider
recommendations made by campus- and district-level committees regarding
policies and proposed budgets.  

PURPOSE

As proposed, S.B. 1822 outlines provisions regarding the planning and
decision-making process of school districts. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 11.201(d), Education Code, to provide that
preparing recommendations for policies to be adopted by the board of
trustees of each independent school district (board) in accordance with
this code, including Section 11.251, and overseeing the implementation of
adopted policies is included in the duties of the superintendent. 

SECTION 2. Amends Section 11.202(b), Education Code, to provide that
developing budgets for the principal's campus in accordance with the
administrative procedure established under Section 11.251(d) is included
in the requirements for each principal. 

SECTION 3. Amends Sections 11.251(b) and (d), Education Code, to require
the board to establish a procedure for district- and campus-level
committees to formally present recommendations directly to the board in
response to a decision of the board or of a principal or superintendent
that is contrary to a committee recommendation.  Requires the
administrative procedure to include a process by which the board and
superintendent consider in a timely manner recommendations from the
districtand campus-level committees concerning the proposed budget adopted
under Section 44.002. Requires the board to ensure that all participants
of the district-level planning and decision-making committee, in the
planning and decision-making process, perform their roles and
responsibilities in accordance with the procedure. 

SECTION 4. Amends Section 44.002(a), Education Code, to require the
superintendent to prepare a proposed budget covering all estimated revenue
and proposed expenditures of the district for the following fiscal year,
on or before a date set by the State Board of Education, in accordance
with the process prescribed under Section 11.251(d). 

SECTION 5. Effective date: September, 1, 1997.
