S.B. 1893

Committee Report (Unamended)

BACKGROUND

Currently, Texas law establishes a minimum number of days for a school
year. In the recodification of the Education Code, the year in the formula
that establishes the minimum days of service required by teachers was left
unchanged. This bill corrects a recodification error in the Education Code
by changing the year of reference in the formula that establishes the
minimum number of days of service required to be served by a teacher for a
school year.

PURPOSE

As proposed, S.B. 1893 corrects a recodification error in the Education
Code by changing the year of reference in the formula that establishes the
minimum number of days of service required to be served by a teacher for a
school year.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any
additional rulemaking authority to a state officer, department, agency or
institution.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 21.401, Education Code, as follows:
Sec. 21.401. MINIMUM SERVICE REQUIRED. Redefines the formula for the
minimum number of days of service formula. Redefines "R2" as equal to
FSP/ADA as determined under Section 21.402 for the 1996-1997, rather than
the 1994-1995, school year. It also redefines MDS as equal to 185 +
(0.33 X (R1 - R2)/(R2/185), rather than (R2/183).

SECTION 2. Effective date: September 1, 1997.

SECTION 3. Emergency clause.
