DIGEST 

Currently, some state agencies, as well as the Office of the Governor,
have specific statutory gift accepting authority.  The operating statute
for the Office of the Secretary of State does not provide language
stipulating the authority of the secretary of state to accept certain
gifts.  This bill authorizes the secretary of state to accept certain
gifts, grants, and donations on behalf of the state related to the office
of the secretary of state.  

PURPOSE

As proposed, S.B. 1903 authorizes the secretary of state to accept certain
gifts, grants, and donations on behalf of the state related to the office
of the secretary of state.  

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Chapter 405A, Government Code, by adding Section
405.005, as follows: 

Sec. 405.005. ACCEPTANCE OF GIFTS, GRANTS, AND DONATIONS.  Authorizes the
secretary of state to accept or solicit gifts, grants, and donations of
money or property on behalf of the state for any lawful public purpose
related to the office or duties of the secretary of state.  Authorizes the
secretary of state to decline to accept a gift, grant, or donation that is
made for a specific purpose if the secretary of state determines the gift
may not be used reasonably or economically for the designated purpose. 

SECTION 2. Emergency clause.
  Effective date: upon passage.
