CJ S.B. 1938 75(R)BILL ANALYSIS JUVENILE JUSTICE & FAMILY ISSUES S.B. 1938 By: ARMBRISTER (RHODES) 5-15-97 Committee Report (Unamended) BACKGROUND Currently, the juvenile board of Hays County is composed of the county judge, the Hays County district judges, the judge of the county court at law, and the county attorney. The commissioners court is allowed to pay juvenile board members additional annual compensation of not more than $300. S.B. 1938 alters the make-up of the board by removing two non-resident district judges and including the district judge of the 22nd judicial district, the judges of the county court at law, the county sheriff, and the criminal district attorney, in an effort to make all of the board members residents of Hays County. In addition, this legislation allows the commissioners court to pay the board members additional annual compensation at its own discretion. PURPOSE As proposed, S.B. 1938 establishes the composition of the Hays County juvenile board and the additional compensation they may be paid by the commissioners court. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 152.1111(a) and (b), Human Resources Code, to provide that the juvenile board of Hays County is composed of the county judge, the district judge of the 22nd judicial district, the judges of the county court at law, the county sheriff, and the criminal district attorney. Deletes existing text regarding the composition of the Hays County juvenile board. Authorizes the commissioners court to pay the juvenile board members additional annual compensation in an amount determined by the commissioners court, rather than of not more than $300 for the duties imposed on the members. SECTION 2. Effective date: September 1, 1997. SECTION 3. Emergency clause.
