DIGEST 

Currently, the City of Austin maintains extraterritorial jurisdiction in
parts of Hays County.  There is a concern that leaving Austin's regulatory
authority in place will delay the delivery of surface water to the area
and jeopardize resources important to Hays County and the City of Austin.
S.B. 1939 would remove the City of Austin's extraterritorial jurisdiction
from Hays County in order to make it more likely that purveyors of water
would be willing to make the necessary infrastructure investments to bring
surface water to Hays County and end the county's dependence on
underground water resources and on-site wastewater systems. 
 
PURPOSE

As proposed, S.B. 1939 outlines provisions regarding limiting the area
that may be included in the extraterritorial jurisdiction of certain
municipalities. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Subchapter B, Local Government Code, by adding Section
42.026, as follows: 

Sec. 42.026. LIMITATION ON EXTRATERRITORIAL JURISDICTION OF CERTAIN
MUNICIPALITIES. Provides that this section applies only to a home-rule
municipality located in whole or in part in a county with a population of
240,000 or less.  Provides that the extraterritorial jurisdiction of the
municipality does not include territory located outside the county in
which a majority of the land area of the municipality is located and
located in a county with a population of 70,000 or less. 

SECTION 2. Effective date: September 1, 1997.

SECTION 3. Emergency clause.
