DIGEST

Currently, there are approximately 17 courts in this state that exercise
"statutory probate court jurisdiction" but are not all necessarily
designed as such. There have been recent efforts to limit this
jurisdiction. This bill would ensure that these courts continue to
exercise such jurisdiction.

PURPOSE

As proposed, S.B. 1952 sets forth provisions regarding the jurisdiction of
certain statutory county courts.

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 5, Texas Probate Code, by adding Subsection (g),
to provide that a statutory county court created under Chapter 25,
Government Code, that has the jurisdiction of a statutory probate court on
August 31, 1997, retains that jurisdiction after that date.

SECTION 2. Effective date: September 1, 1997.

SECTION 3. Emergency clause.
