DIGEST 

Most hospital districts in the State of Texas allow their voters the
opportunity to hold an election to dissolve the district.  However,
current law does not provide for an election to dissolve the Montgomery
County Hospital District upon petition by voters of the district.  This
bill sets forth provisions regarding the dissolution of the Montgomery
County Hospital District.     

PURPOSE

As proposed, S.B. 1957 sets forth provisions regarding the dissolution of
the Montgomery County Hospital District.  

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Chapter 258, Acts of the 65th Legislature, Regular
Session, 1977, by adding Sections 23A and 23B, as follows: 

Sec.  23A.  Authorizes the Montgomery County Hospital District (district)
to be dissolved as  provided by this section.  Sets forth provisions
regarding an election for dissolution of the district by the board of
directors of the district (board).  

Sec. 23B.  Requires the board to continue to control and administer the
property, debts, and assets of the district until all funds have been
disposed of and all district debts have been paid or settled if the board
finds that the district is dissolved but does not transfer certain assets
to Montgomery County or another governmental entity in the district.  Sets
forth certain duties to be administered by the board after the dissolution
of the district.  Requires the board to file a written report with the
commissioners court of Montgomery County setting forth a summary of the
board's actions in dissolving the district.  Requires the commissioners
court to enter an order dissolving the district by a certain date after
receiving the board's report. 

SECTION 2. Emergency clause.
  Effective date:  upon passage.
