A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the extension of the full faith and credit of the state
1-3 to support the Texas tomorrow fund.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 54.619(g), Education Code, is amended to
1-6 read as follows:
1-7 (g) If in any fiscal year there is not enough money in the
1-8 fund to pay the tuition and required fees of the institution of
1-9 higher education in which a beneficiary enrolls or the appropriate
1-10 portion of the tuition and required fees of the private or
1-11 independent institution of higher education in which the
1-12 beneficiary enrolls as provided by the prepaid tuition contract,
1-13 the comptroller shall transfer to the fund out of the first money
1-14 coming into the state treasury not otherwise appropriated by the
1-15 constitution [the legislature may appropriate to the fund] the
1-16 amount necessary for the board to pay the applicable amount of
1-17 tuition and required fees of the institution.
1-18 SECTION 2. This Act takes effect on the date on which the
1-19 constitutional amendment proposed by H.J.R. No. 8, 75th
1-20 Legislature, Regular Session, 1997, takes effect. If that
1-21 amendment is not approved by the voters, this Act has no effect.
1-22 SECTION 3. The importance of this legislation and the
1-23 crowded condition of the calendars in both houses create an
1-24 emergency and an imperative public necessity that the
1-25 constitutional rule requiring bills to be read on three several
2-1 days in each house be suspended, and this rule is hereby suspended.
