                                A BILL TO BE ENTITLED

 1-1                                   AN ACT

 1-2     relating to the authority of the governing body of a municipality

 1-3     to declare a speed limit for a farm-to-market or ranch-to-market

 1-4     road located in the municipality.

 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

 1-6           SECTION 1.  Section 545.359, Transportation Code, is amended

 1-7     to read as follows:

 1-8           Sec. 545.359.  CONFLICTING DESIGNATED SPEED LIMITS.  (a)  An

 1-9     order of the Texas Transportation Commission declaring a speed

1-10     limit on a part of a designated or marked route of the state

1-11     highway system made under Section 545.353 or 545.362 supersedes any

1-12     conflicting designated speed established under Sections 545.356 and

1-13     545.358.

1-14           (b)  Subsection (a) does not apply to a designated speed

1-15     established under Section 545.356 for a farm-to-market or a

1-16     ranch-to-market road.

1-17           SECTION 2.  The importance of this legislation and the

1-18     crowded condition of the calendars in both houses create an

1-19     emergency and an imperative public necessity that the

1-20     constitutional rule requiring bills to be read on three several

1-21     days in each house be suspended, and this rule is hereby suspended.
